A proteção do consumidor e o consumo sustentável: a dimensão global e regional do consumo sustentável e as iniciativas nacionais

A metodologia adotada é a hermenêutico-filosófica. Os objetivos são: a) investigar, a partir do paradigma cosmopolita, a existência de bens comuns; b) constatando-se a existência dos bens comuns, propor uma adequação na compreensão de acesso à justiça e o papel das jurisdições na proteção dos bens comuns. Abstract : This article aims to investigate the possibility of the existence of a transnational jurisdiction conceived as an integration of state juris- dictions for the protection and accountability in cases of human rights violations. Therefore, it is based on the cosmopolitan paradigm, in or- der to propose a bias that allows dialogue beyond the traditional limits of the borders of the modern State. This perspective has its importance reinforced from the understanding that judicial cooperation conceived reveals itself as a necessary counterpoint to the process of economic glo- balization, with neoliberal contours. Thus, access to justice is resumed, as the main reference for the realization of world justice, in order to maintain that state jurisdictions should act not only when there is a direct relationship between States with the damage or conduct of agents in other territories or even by courtesy to the acts of the authorities of other States, but because the protection of human rights horizontally affects the state jurisdictions, in such a way that they cannot be con- ceived as if state property were, but rather, as tools in the service of the protection of common goods of humanity translated as human rights. The adopted methodology is the hermeneutic-philosophical. The ob- jectives are a) to investigate, from the cosmopolitan paradigm, the ex- istence of common goods; and b) verifying the existence of common assets, propose adequacy in the understanding of access to justice and the role of jurisdictions in the protection of common goods.
